The Nigerian Communications Commission (NCC) has reminded Original Equipment Manufacturers (OEMs) of their obligations. They prompt importers, distributors and retailers of SIM-enabled devices to be aware of their statutory obligations. The commission stated that OEMs are to ensure products entering and sold in Nigeria comply with its Type Approval and device verification requirements.
According to the Commission the process is to strengthen monitoring and enforcement of existing regulations through technology-enabled verification. Adding that it will further ensure that communications devices imported, distributed and used in the country meet applicable standards.
Regulations
In a compliance notice, NCC cited the 2003 Communications Act, the Type Approval Regulations 2024, and the Type Approval Business Rules 2024. It noted these as the legal and regulatory framework governing the requirements.
Under the directive, all device models intended for importation, assembly, distribution or sale in Nigeria must obtain the required NCC Type Approval. The commission said it is in line with Section 132 of the 2003 Communications Act and Regulation 4 of the Type Approval Regulations 2024.
Compliance
The Commission also said OEMs, Original Device Manufacturers (ODMs), importers, and other responsible suppliers must ensure that the International Mobile Equipment Identity (IMEI) information of individual devices is submitted through the approved compliance process for verification before the devices are sold or distributed.
Distributors, dealers and retailers have been advised to review existing stock to confirm compliance with Type Approval and device verification requirements. All entities to work with their suppliers to address any outstanding issues.
Similarly, new imports must satisfy the applicable approval and verification requirements before being placed on the Nigerian market.
Stakeholders Engagement
The NCC said it had conducted extensive engagements with stakeholders and relevant industry associations as part of its participatory regulatory approach.
Businesses that have not participated in the engagements or remain uncertain about the compliance process encouraged to seek guidance through the Commission’s approved onboarding and support channels.
Customers Protection
According to the Commission, the automated Type Approval Compliance process will strengthen oversight of devices entering the country. Additionally, it will improve its ability to identify irregularities in their importation and distribution.
The initiative will also be implemented in collaboration with the Nigeria Customs Service (NCS) to support the reconciliation of import records. It will further enhance compliance with applicable duties and fair competition among businesses.
Advantages
Furthermore, NCC said the framework would help prevent businesses that comply with regulatory requirements from being disadvantaged by those that fail to meet their obligations.
It however warned that, upon full implementation, devices that do not satisfy the applicable requirements will be restricted. Such devices will not be allowed access to Nigerian mobile telecommunications networks.
The NCC reaffirmed its commitment to working with industry stakeholders to facilitate compliance, protect consumers and promote a fair and sustainable market for communications devices.
